TRADEMARKS

TM Granting gives the exclusive right to use in acertain class or classes (it may be renewed every 10 years).

TM can be a sign or word/s-wording or definition or figure or firm name Etc., for a product/s or service/s.

Colours can be claimed.

Certain Words can be disclaimed.

The products and services to identify are subdivided in the well known 42 classes according to the International TM Classification: 5-languagesInternational Classification of Trademarks
The TM must be new, and not in confusion with prior TM already filed or used in the same class/es.
The Spanish Trademark and Patent Office carry out a novelty examination.
The Italian Trademark and Patent Office does not carry out a novelty examination.

Prior search is strongly suggested


It should be noted that local prior use is not an obstacle for registration.
The registration becomes effective in the entire territory excluding the local regions where local prior use is in force.
Prior use in a local area is still maintained even even if a successive TM will be granted.

It is essential first to verify that confusing prior marks do not exist.

A TM can be declared void for NON USE.

The mark may be filed in Italy and Spain or it can be filed as an International TM or it can be filed as a
Community Trademark (Alicante - Spain Headquarters) OHNI Filing.
